Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Kutay Kurnaz, an individual developer based in Turkey ("we," "us," "Tsunagi"), governing your use of the Tsunagi mobile application on Android and iOS (the "App").

By downloading, installing, or using Tsunagi, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

Tsunagi is intended for users who are at least 18 years old (or the age of majority in your country, if higher). By using the App, you represent that you meet this requirement.

2. The Service

Tsunagi is a spaced-repetition flashcard app. It works fully offline — there is no account creation or sign-in, and no AI-powered features. Your notes, flashcards, study data, and any media you attach are stored locally on your device. The only outside service Tsunagi uses is PostHog for basic, anonymous app analytics, as described in our Privacy Policy.

We may add, change, or remove features at any time, including features that would change how data is handled — if we do, we will update our Privacy Policy in advance.

3. Your Content

You own your content. Notes, flashcards, media, and any other content you create or import into Tsunagi ("Your Content") belongs to you.
We store Your Content only locally on your device to operate the App for you. We do not access, transmit, or use Your Content for any other purpose, and we do not claim ownership over it.
You are solely responsible for Your Content and for having the rights to store or import it. Do not use Tsunagi to store content that is illegal or infringes third-party rights.
Because Your Content is stored locally on your device by design, we cannot recover it for you if you uninstall the App, lose your device, or clear app data, unless you have made your own backup/export.

4. Purchases

Tsunagi does not currently offer any paid subscriptions or in-app purchases. If we introduce them in the future, purchases would be billed and processed entirely through the Apple App Store or Google Play — we would not collect or store payment card information ourselves. 5. Third-Party Services

Tsunagi relies on PostHog (analytics) to operate, as described in our Privacy Policy. We may add new features in the future, such as optional account sign-in or optional cloud sync — this section and our Privacy Policy will be updated in advance if we do. Your use of features backed by a third-party service is also subject to that provider's own terms. We are not responsible for the availability or performance of third-party services outside our control.

6. Acceptable Use

You agree not to:

Use the App for any unlawful purpose or in violation of these Terms;
Attempt to reverse-engineer, decompile, or extract source code from the App, except as permitted by applicable law;
Interfere with or disrupt the App's operation.

We may take reasonable steps to prevent access from users who violate this section.

7. Intellectual Property

The App itself — its design, code, branding, and features (excluding Your Content and third-party open-source components) — is owned by Kutay Kurnaz and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding beyond what is necessary to use the App as intended.

8. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted or error-free.

Nothing in this section limits any statutory rights you have as a consumer under mandatory Turkish consumer-protection law that cannot be waived by agreement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Kutay Kurnaz will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the App — including data loss from uninstalling the App, device loss, or third-party service outages. Our total liability for any claim arising from these Terms or the App will not exceed the amount you paid us (if any) in the 12 months preceding the claim.

This section does not limit liability that cannot be limited under applicable law (including mandatory Turkish consumer-protection provisions).

10. Termination

You may stop using the App at any time by uninstalling it. We may discontinue the App (or any feature) at any time, with notice where reasonably practicable. Sections that by their nature should survive termination (e.g., §§ 3, 8, 9, 11) will survive.

11. Governing Law

These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the App will be subject to the exclusive jurisdiction of the competent courts of Turkey, except where mandatory consumer-protection law in your country of residence grants you the right to bring a claim in your local courts.

12. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, notify you in-app or via the app store listing before the change takes effect where required by law. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
